General terms and conditions of accommodation

A natural person registered in the Trade Register kept by the Municipal Office of Broumov.

These terms apply from 2 October 2026.

1. Introduction

These terms govern the rights and obligations of the operator of Vila Marcelka (the “host provider”) and the guest. By sending a booking, the guest confirms that they have read and accept these terms.

2. Booking

A stay can be booked online using the booking form on this website, by e-mail or by phone. When booking through the online booking form, the accommodation contract is concluded at the moment the order is sent – the booking is then binding and confirmed, and the guest receives the confirmation by e-mail without delay. When booking by e-mail or by phone, the contract is concluded when the host provider confirms the booking.

3. Prices and services

Accommodation prices are shown on the website and in the booking form. Prices already include the local accommodation tax in accordance with applicable law and the rules of the City of Broumov. The total price stated in the booking confirmation is binding. The host provider may change the agreed terms of the stay in circumstances beyond their control (e.g. force majeure) and will inform the guest without undue delay.

4. Cancellation by the guest and cancellation terms

4.1 The guest has the right to withdraw from the accommodation contract (cancel the booking) at any time before the day of arrival, in writing by e-mail to: marcela@ubytovani-broumov.cz. The time of cancellation is determined by the date and time the e-mail is delivered to the host provider.

4.2 If the guest cancels the booking, the host provider is entitled to charge cancellation fees calculated from the total accommodation price as follows:

• More than 14 days before arrival: 0 % of the accommodation price (free cancellation).
• 14 to 7 days before arrival: 50 % of the accommodation price.
• Less than 7 days before arrival or no-show: 100 % of the accommodation price.

4.3 Because the contract concerns accommodation to be provided on a specific date or during a specific period, the consumer does not have the standard 14-day right to withdraw from a distance contract without giving a reason. This follows from the exception under Section 1837 of the Czech Civil Code. This does not affect the guest’s right to cancel the booking under the cancellation terms above.

5. Refunds

5.1 If the guest becomes entitled to a refund of the amount paid (or part of it after deduction of the cancellation fee), the host provider will refund it no later than 14 days after the cancellation, using the same method by which it was paid, unless the parties agree otherwise.

6. House rules

Check-in is from 3:00 PM and rooms must be vacated by 10:00 AM unless agreed otherwise. Pets cannot be accommodated. All indoor areas of the villa are non-smoking; smoking is allowed only in the designated outdoor area. A guest who breaks the indoor smoking ban must pay the host provider a contractual penalty of CZK 5,000. The guest is liable for any damage they cause to the property.

7. Rights arising from defective performance (complaints)

7.1 The guest is entitled to the proper provision of the accommodation services as agreed in the contract. If the accommodation provided or related services show defects (e.g. non-functioning equipment, insufficient cleaning, no hot water or Wi-Fi), the guest has the right to make a complaint.

7.2 The guest must make the complaint without undue delay, immediately after discovering the defect, directly to the host provider (in person, by phone at +420 734 405 063 or by e-mail), so that the problem can be remedied as soon as possible. The host provider need not take into account later complaints (e.g. only after the stay has ended) if the defect could have been remedied during the stay.

7.3 The host provider or a person authorised by them will decide on the complaint immediately, or within 3 working days in complex cases. The complaint, including remedying the defect, will be settled without undue delay, but no later than 30 days from the day it was made, unless the host provider and the guest agree on a longer period.

7.4 If the complaint is justified, the guest is entitled to have the defect remedied free of charge or to a reasonable discount on the accommodation price.

8. Dispute resolution

The competent entity for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 796/44, 110 00 Prague 1. Information about out-of-court dispute resolution is available at coi.gov.cz.

9. Final provisions

These terms form an integral part of the accommodation contract. Matters not covered by them are governed by the laws of the Czech Republic, in particular the Civil Code.

Privacy policy

This policy explains what personal data we process, why and for how long, who we share it with and what your rights are. It applies from 2 October 2026.

What data we process and why

• Booking and stay – name, contact details, dates, number of guests and payment details. Processing is necessary to conclude and perform the accommodation contract (Art. 6(1)(b) GDPR).
• Guest register – data we are required by law to record (guest register for the local accommodation tax under Section 3g of Act No. 565/1990 Coll. – name, date of birth, address, type and number of identity document, dates of stay; for foreign nationals including EU citizens also citizenship, visa number and purpose of stay for reporting to the Czech Police and the guest book under Sections 101–102 of Act No. 326/1999 Coll.). You enter the data in the online check-in. The legal basis is compliance with a legal obligation (Art. 6(1)(c) GDPR); without it we cannot accommodate you.
• Enquiries and gift voucher orders – name, e-mail, where applicable phone number and the text of your message from the forms on this website. General enquiries are processed on the basis of our legitimate interest in responding to your message (Art. 6(1)(f) GDPR). If the enquiry or order is aimed at entering into a contract, processing is also necessary in order to take steps at your request before entering into a contract (Art. 6(1)(b) GDPR).
• Traffic measurement – only with your consent (Art. 6(1)(a) GDPR), using Google Analytics 4.

The chat assistant on this website answers directly in your browser from the content of these pages and does not send anything anywhere.

Who we share data with

• our web hosting provider WEDOS Internet, a.s., whose servers run our booking system;
• Google (Google Analytics only with consent, the embedded Google map only with consent or after a click); Google may transfer data to the USA under the EU–U.S. Data Privacy Framework;
• our web hosting provider WEDOS Internet, a.s.;
• the Czech Police (reporting of foreign guests via the UbyPort system) and the Broumov Municipal Office (checks of the accommodation tax); other public authorities only where the law requires it.

How long we keep data

We keep booking data for the duration of the contract and then for the periods required by law (guest register and guest book 6 years from the last entry, accounting and tax records usually 5 to 10 years). Messages from the forms are kept only as long as needed to deal with the enquiry and any follow-up. Google Analytics data is kept for no longer than 14 months.

Your rights

You have the right to access your data, have it corrected or erased, restrict processing, data portability and the right to object to processing based on legitimate interest. You can withdraw your consent to analytics cookies at any time. Please send requests to marcela@ubytovani-broumov.cz. You also have the right to lodge a complaint with the Czech Office for Personal Data Protection (uoou.gov.cz).

Cookies and consent settings

Technical cookies and similar technologies that are necessary for the proper operation of the website and services you request are used without consent in accordance with Section 89(3) of Czech Act No. 127/2005 Coll., on Electronic Communications. Analytics and other non-essential cookies are used only with your prior consent under the GDPR. Until you consent, neither analytics nor Google maps are loaded.

Necessary (always active) – vm_cookie_consent (browser storage, 12 months) remembers your choice; VMREZSESS (until the browser is closed) enables online check-in and booking payment. Our booking form uses the same cookie so that the order can be sent securely.

Analytics (only with consent) – Google Analytics 4 (Google Ireland Ltd.) sets the cookies _ga and _ga_5WVTY8HWJH, valid for up to 2 years. The data is aggregated and never used for advertising or profiling; Google advertising features are switched off. Data may be transferred to the USA under the EU–US Data Privacy Framework.

Maps and external content (only with consent) – embedded Google maps are not loaded without consent; instead you see a “Show map” button that loads the map just once. When a map is displayed, Google processes your IP address and may store its own cookies (e.g. NID, AEC, SOCS, up to 13 months).

Your choice is valid for 12 months, after which the website asks again. You can change or withdraw your consent at any time via “Cookie settings” in the footer of every page or here; after withdrawal we delete the analytics cookies. You can also delete cookies in your browser settings.
